Terms and Conditions for the Online Shop
§1 Scope of Application
These terms and conditions apply to all deliveries, unless deviating individual agreements are made in writing. General terms and conditions of the buyer are not recognized. Separate general terms and conditions exist for events (e.g., birthdays, weddings, corporate events) as well as for our accommodation/hotel services.
§2 Conclusion of Contract for Online Orders
Customer orders and purchases constitute a binding offer to conclude a contract. The contract is only formed upon delivery of the goods to the address specified in the order. The contractual partner is Scheunenwirtin Renate Lieb und Günther Saiger GbR Helmut-Ginzkey-Weg 10 D-73566 Bartholomä
§3 Prices and Payment
The prices stated include statutory VAT and other price components. Any shipping costs are added. We reserve the right to make price changes and errors. Consumers have the option to pay via PayPal, credit card (Visa, Mastercard), and Sofort transfer. Payment on account is generally not possible.
§4 Retention of Title
We retain ownership of the goods until the purchase price has been paid in full.
§5 Packaging and Shipping Costs
For each order and delivery address, we charge a shipping fee of 5.95 euros for deliveries within the Federal Republic of Germany up to an order value of 50.00 euros. For orders with a value of 50.00 euros or more per delivery address, the shipping fee per delivery address is waived entirely. If we deliver your order in several parts for technical reasons, we will, of course, only charge the shipping fee once.
§6 Delivery
Unless we clearly state otherwise in the product description, all items offered by us are ready for immediate dispatch. We usually ship food on Fridays. Delivery is made via parcel service providers (e.g., DHL). Tickets are sent to the specified email address. Physical goods (including gift packages) are sent to the billing or delivery address on file.
§7 Transfer of Risk
The risk passes to the buyer as soon as the shipment has been handed over to the person carrying out the transport or has left our business premises for dispatch, regardless of whether the dispatch takes place from the place of performance and who bears the freight costs. If the goods are ready for dispatch and the dispatch or acceptance is delayed for reasons for which the purchasing buyer is responsible, the risk passes to the buyer upon receipt of the notification of readiness for dispatch. Handover is deemed to have occurred if the buyer is in default of acceptance.
§7 Returns, Exchanges, and Warranty
Tickets are generally excluded from return. Furthermore, there is no entitlement to any discounts after the tickets have been purchased. In individual cases, Scheunenwirtin may grant an exchange at its own discretion if a person is unable to attend. If items show obvious material or manufacturing defects, including transport damage, please report such defects immediately to us or to the delivery person who delivers the items. Failure to make this complaint has no consequences for your legal claims. For all defects of the purchased item occurring during the statutory warranty period, you may choose to exercise your legal claims for supplementary performance, for rectification of defects/new delivery, and – if the legal requirements are met – further claims for reduction or withdrawal, as well as for damages, including compensation for damage instead of performance and compensation for your futile expenses.
§7 Cancellation Policy
As part of these Terms and Conditions, you will find the cancellation policies required by law and case law below. We print these as required and apply them as required.
§8 Cancellation of an Event
In the event of a cancellation of an event, Scheunenwirtin offers the consumer the opportunity to exchange their tickets for an equivalent ticket, receive a voucher, or request a refund of the purchase price. This must be done no later than 4 weeks after the cancellation of the event. After this period, any claims expire.§9 Loss or Transfer of a Ticket
Tickets lose their validity after the end of the printed performance and are not transferable to other events. In principle, tickets are not transferable to third parties. However, this is possible if you inform us in advance and we agree to the transfer.
§10 Vouchers
Value vouchers have an expiration date of two years. After that, Scheunenwirtin may accept them as a gesture of goodwill at its own discretion, but no obligation results. Ticket vouchers for a specific event are only valid for that event and cannot be rebooked for other dates. Vouchers for goods with a free choice of date can be redeemed within two years. After that, Scheunenwirtin may accept them as a gesture of goodwill at its own discretion, but no obligation results. Duplicating, editing, or manipulating the vouchers is not permitted. We assume no liability for loss, theft, or illegibility and cannot replace the voucher.
§11 Protection of Minors
In accordance with the Youth Protection Act, we only deliver alcoholic beverages to persons aged 18 and over.
§12 Visiting the Estate
Visitors enter the estate at their own risk. Scheunenwirtin assumes no liability for any damage that may occur, unless willful misconduct can be attributed to it.
§13 Conduct During the Performance
Audio, film, photo, and video recordings are prohibited during the event.
§14 Contract Language
The contract language is exclusively German.
§15 Miscellaneous
Our products are handcrafted. There may therefore be slight deviations from images and specifications. The contracts concluded with us are subject to German law, excluding the UN Convention on Contracts for the International Sale of Goods. For fully qualified merchants, the competent court at the registered office of Scheunenwirtin is the exclusive place of jurisdiction. Should individual provisions of these Terms and Conditions be or become invalid or void, the validity of the remaining provisions shall not be affected. In all other respects, the statutory regulations apply.
§16 Data Protection
We treat all personal data provided by the customer confidentially. The data necessary for the execution of the contract will be stored and processed electronically, insofar as this is necessary for the processing and execution of the contract and for the maintenance of the ongoing customer relationship. Your data collection, data transmission, and/or other processing of personal customer data for other purposes will not take place. Further details can be found in our privacy policy.
